1 USER CONDUCT
Get Online Sydney services may only be used for lawful purposes. Transmission of any material in violation of any Federal, State, Local or international laws is strictly prohibited. This includes, but is not limited to copyrighted and/or trademarked material, material legally judged to be threatening, obscene, slanderous or destructive, and material related to or promoting terrorism or crime.
2 INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Get Online Sydney from any and all liability, penalties, losses, damages, costs, expenses, legal fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Get Online Sydney, or any other party or parties without limitation or exception. This indemnification holds harmless agreement applies to all issues associated with your account, including but not limited to domain name selection and Web site content.
3 PAYMENT TERMS
Get Online Sydney does not extend credit to Subscribers.
Appropriate payments for the services received from Get Online Sydney are to be supplied in advance of the time period during which such services are provided.
Setup fees are non-refundable once setup is completed.
Services will be billed on a recurring basis, unless written/email notice is provided 30 days prior to renewal. Credit card prepayments will be billed and charged automatically, and Get Online Sydney may apply the amount due to the provided card at any time.
Subscribers are capped at their metered services limit therefore will not incur any additional charges. Subscriber is responsible for monitoring transfer, bandwidth and space utilisation, and other metered services and increasing their plan when required by their usage.
Customers paying by credit card are charged the first business day prior to their account due date, allowing a maximum grace period of 48 hours after the first charge attempt before their service is interrupted.
Get Online Sydney only accepts payment via PayPal and Credit Card. Bank transfer or cheque are not an accepted payment method.
A late payment fee of 10% will be assessed if payment are not received by due date for invoices which will accumulate monthly.
Suspension of account will occur where payment has not been received 60 days from original due date.
If the Subscriber has not fulfilled its dues to Get Online Sydney, the service will be terminated after 30 days of the initial suspension date.
Term of contract is ongoing until 30 days email/written notice is given by either of the parties.
4 NO WARRANTIES
Get Online Sydney makes no warranties or representations of any kind for the services being offered. The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
Get Online Sydney provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components. Under no circumstances shall Get Online Sydney be liable for any direct, indirect, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your Web space, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with Get Online Sydney services or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service.
You understand that by placing information on Get Online Sydney servers that such information becomes available to all Internet users and that Get Online Sydney has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of Get Online Sydney servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through Get Online Sydney or on the Internet generally.
4.1 BACKUP OF DATA
Your use of the service is at your sole risk. Get Online Sydney is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Get Online Sydney servers.
5 TERMINATION
5.1 REFUSE OR DISCONTINUE SERVICE
Get Online Sydney reserves the right to refuse or discontinue service to anyone at Get Online Sydney sole discretion. Get Online Sydney may deny you access to all or part of the service without notice to you or any third party providers if you engage in any conduct or activities that Get Online Sydney in its sole discretion believes violates any of the terms and conditions in this agreement.
5.2 CANCELLATION OF SERVICE
Service may be cancelled at any time by either written notice or emailing us at accounts@getonlinesydney.com.
Get Online Sydney offers refund on the monthly hosting fees to the customer upon cancellation made prior to the first 30 days of the first payment for the Service.
Get Online Sydney issues no refunds for cancellation of monthly subscriptions.
All annual and biannual plans can be cancelled at any time. Should the subscription be cancelled before the subscription due date, the Subscriber will be provided with a refund. The refund amount will be calculated based on maximum monthly subscription term.
Refunds offered by Get Online Sydney does not include any setup fees, transfer fees or domain name registrations.
6 HUMAN SERVICES
6.1 REQUIREMENTS
Use of Get
Online Sydney services requires a certain level of knowledge in the use of
Internet languages, protocols, and software. This level of knowledge varies
depending on the anticipated use and desired content of Customer's Webspace by
the Customer.
The following examples are offered:
Web Publishing:
requires basic knowledge of HTML, properly locating and linking documents,
FTPing files to and from the server, Graphics, Text, Sound, imagemapping, etc.
CGI-Scripts:
require a basic knowledge of the UNIX / Linux environment, file permissions,
etc.
The Client agrees that he or she has the necessary knowledge to create and
maintain their webpages. Client agrees that it is not the responsibility of
Get Online Sydney to provide this knowledge. Support and coaching is included
with hosting, but basic training is separate and optional.
6.2 CONSULTING AND TECH SUPPORT
Any information, advice, concept or idea that is given to a client may have been given to other clients before and may be given to other clients in the future. It is up to the client to make use of that information in a timely manner and no client shall expect that any such information will be theirs exclusively for any specific amount of time.
Projects which do not form part of a purchased package will be scoped, quoted, agreed and part-paid prior to the commencement of work. Any changes to the scope during the course of the project will incur additional fees.
